CONDITION OF SALE

These conditions are valid only between Società Agricola La Fornace di Banti Daniele & Co. s.a.s. hereinafter referred to as the SUPPLIER COMPANY and any person who makes online purchases on this site, hereinafter referred to as the “CUSTOMER”.

These conditions may be subject to changes, the date of putting online is equivalent to the date of entry into force.
These general conditions govern purchases made in accordance with directive 2011/83 / EU on consumer rights, amending directives 93/13 / EEC and 1999/44 / EC and repealing directives 85/577 / EEC and 97/7 /THERE IS. (14G00033).

ARTICLE 1 subject of the contract

With these general conditions of sale, THE SUPPLIER COMPANY sells and the CUSTOMER remotely purchases the tangible movable property indicated and offered for sale on this site. The contract is concluded exclusively through the internet, by accessing the CUSTOMER to the site address and the creation of a purchase order according to the procedure provided by the site itself.

ARTICLE 2 conclusion and efficacy of the contract

1. The sale will be considered concluded with the sending by the SUPPLIER COMPANY to the CUSTOMER of an order confirmation e-mail. The e-mail contains the details of the CUSTOMER and the order, the price of the goods purchased, the transport costs and the shipping address to which the goods will be sent. The CUSTOMER undertakes to verify the correctness of the data contained therein and to promptly communicate any corrections.

2. The SUPPLIER COMPANY undertakes to describe and show the items sold on the site as well as possible. Nevertheless, some errors, inaccuracies or small differences between the site and the actual product may emerge. Furthermore, the photographs of the products presented on the site do not constitute a contractual element, as they are only representative.

ARTICLE 3 Product availability

1. The availability of the products refers to that present when the CUSTOMER consults the product data sheets; however, this must be considered purely indicative because, due to the simultaneous presence on the site of multiple users, the products could be sold to others before the order is confirmed.

2. Even after sending the order confirmation e-mail by THE SUPPLIER COMPANY, there may be cases of partial or total unavailability of the goods. The CUSTOMER will be promptly informed and will be able to decide whether to accept the delivery of only the available products or request the cancellation of the order by communicating via e-mail to customer service.

ARTICLE 4 Terms of payment

1. Any payment by the CUSTOMER can only be made through one of the payment methods indicated by the SUPPLIER COMPANY on the site.

2. The communications relating to the payment and the data communicated by the CUSTOMER when this is done take place on special protected lines and with all the guarantees ensured by the use of the security protocols provided by the payment circuits.

ARTICLE 5 Prices

1. The prices of the products displayed can be VAT. included / excluded. However, it is indicated on the page if the value added tax is applied.

2. Shipping costs are not included in the purchase price, but are indicated and calculated at the time of the conclusion of the purchase process before payment is made.

3. The CUSTOMER accepts the right of THE SUPPLIER COMPANY to change its prices at any time, however the goods will be invoiced on the basis of the prices indicated on the site at the time of the order and confirmed in the e-mail sent as confirmation of the acquisition of the order.

ARTICLE 6 Right of withdrawal

1. In accordance with the legal provisions in force (articles 52/59 of Legislative Decree 21/2014), the CUSTOMER has the right to withdraw from the purchase without any penalty and without specifying the reason, within 14 days from the date of the physical possession of the asset, in accordance with the procedures provided for in the aforementioned Legislative Decree.

ARTICLE 7 Methods and Delivery terms

1. The products will be delivered by express courier to the address indicated by the CUSTOMER at the time of the order.

2. For each order placed on the site, the SUPPLIER COMPANY will issue an invoice for the material shipped, after the order has been processed. For the issuance of the invoice, the information provided by the CUSTOMER during the purchase procedure is valid. After the invoice has been issued, it will not be possible to make any changes to the data indicated therein

3. The SUPPLIER COMPANY undertakes to deliver the goods within 30 days from the day following that of the order confirmation by the CUSTOMER.

ARTICLE 8 Responsibility

1. THE SUPPLIER COMPANY assumes no responsibility for disservices attributable to force majeure or unforeseeable circumstances, even if dependent on malfunctions and disservices of the internet network, in the event that it fails to execute the order within the time stipulated in the contract .

2. The availability of each item is for information only, is not contractual and the seller cannot be held liable in the event of unavailability of one or more products.

ARTICLE 9 Integrity

These General Conditions of Sale are made up of all the clauses that compose them. If one or more provisions of these General Conditions of Sale is considered invalid or declared as such pursuant to the law, regulation or following a decision by a court with jurisdiction, the other provisions will continue to have full force and effect.

ARTICLE 10 Applicable law and competent jurisdiction

Any dispute that does not find an amicable solution will be submitted to the exclusive jurisdiction of the Court of the CUSTOMER’s place of residence or domicile, if located in the territory of the State.

ARTICLE 11 Privacy Policy

The Customer is protected by the Italian legislation regarding the Privacy Policy (Legislative Decree 196/2003).

ARTICOLO 1 – Oggetto del contratto

Con le presenti condizioni generali di vendita, L’AZIENDA FORNITRICE vende e il CLIENTE acquista a distanza i beni mobili materiali indicati ed offerti in vendita sul presente sitot. Il contratto si conclude esclusivamente attraverso la rete internet, mediante l’accesso del CLIENTE all’indirizzo del sito e la realizzazione di un ordine di acquisto secondo la procedura prevista dal sito stesso.

ARTICOLO 2 – Conclusione ed efficacia del contratto

1. La vendita sarà considerata conclusa con l’invio da parte DELL’AZIENDA FORNITRICE al CLIENTE di un’e-mail di conferma dell’ordine. L’e-mail contiene gli estremi del CLIENTE e dell’ordine, il prezzo della merce acquistata, le spese di trasporto e l’indirizzo di spedizione al quale sarà inviata la merce. Il CLIENTE si impegna a verificare la correttezza dei dati in essa contenuti e a comunicare tempestivamente eventuali correzioni.

2. L’AZIENDA FORNITRICE si impegna a descrivere e presentare gli articoli venduti sul sito nel miglior modo possibile. Ciononostante potrebbero evidenziarsi alcuni errori, imprecisioni o piccole differenze tra il sito e il prodotto reale. Inoltre le fotografie dei prodotti presentate sul sito non costituiscono elemento contrattuale, in quanto solo rappresentative.

ARTICOLO 3 – Disponibilità dei prodotti

1. La disponibilità dei prodotti si riferisce a quella presente nel momento in cui il CLIENTE consulta le schede del prodotto; questa deve comunque essere considerata puramente indicativa perché, per effetto della contemporanea presenza sul sito di più utenti, i prodotti potrebbero essere venduti ad altri prima della conferma dell’ordine.

2. Anche in seguito all’invio dell’e-mail di conferma dell’ordine da parte DELL’AZIENDA FORNITRICE, potrebbero verificarsi casi di indisponibilità parziale o totale della merce. In questa eventualità, il CLIENTE verrà tempestivamente informato e potrà decidere se accettare la consegna dei soli prodotti disponibili o richiedere l’annullamento dell’ordine comunicandolo via e-mail al servizio clienti.

ARTICOLO 4 – Modalità di pagamento

1. Ogni pagamento da parte del CLIENTE potrà avvenire unicamente tramite uno dei metodi di pagamento indicati dall’AZIENDA FORNITRICE sul sito.

2. Le comunicazioni relative al pagamento e i dati comunicati dal CLIENTE nel momento in cui questo viene effettuato avvengono su apposite linee protette e con tutte le garanzie assicurate dall’utilizzo dei protocolli di sicurezza previsti dai circuiti di pagamento.

ARTICOLO 5 – Prezzi

1. I prezzi dei prodotti esposti possono essere I.V.A. inclusa/esclusa. Viene comunque indicato nella pagina, se l’imposta sul valore aggiunto è applicata.

2. I costi di spedizione non sono compresi nel prezzo d’acquisto, ma sono indicati e calcolati al momento della conclusione del processo di acquisto prima dell’effettuazione del pagamento.

3. Il CLIENTE accetta la facoltà di DELL’AZIENDA FORNITRICE di modificare i suoi prezzi in qualsiasi momento, tuttavia la merce sarà fatturata sulla base dei prezzi indicati sul sito al momento dell’ordine e confermati nell’e-mail inviata come conferma dell’acquisizione dell’ordine.

ARTICOLO 6 – Diritto di recesso

1. Conformemente alle disposizioni legali in vigore (artt. 52/59 del D.lgs. 21/2014) il CLIENTE ha diritto di recedere dall’acquisto senza alcuna penalità e senza specificarne il motivo, entro il termine di 14 giorni utili dalla data del possesso fisico del bene, secondo le modalità previste nel citato D.lgs.

ARTICOLO 7 – Modalità e termini di consegna

1. I prodotti saranno consegnati tramite corriere espresso all’indirizzo indicato dal CLIENTE al momento dell’ordine.

2. Per ogni ordine effettuato sul sito L’AZIENDA FORNITRICE emette fattura del materiale spedito, successivamente all’evasione dell’ordine. Per l’emissione della fattura fanno fede le informazioni fornite dal CLIENTE durante la procedura di acquisto. Dopo l’emissione della fattura, non sarà possibile apportare alcuna modifica ai dati indicati nella stessa.

3. L’AZIENDA FORNIRICE si impegna a consegnare la merce entro 30 giorni decorrenti dal giorno successivo a quello della conferma d’ordine da parte del CLIENTE.

ARTICOLO 8 – Responsabilità

1. L’AZIENDA FORNITRICE non assume alcuna responsabilità per disservizi imputabili a causa di forza maggiore o caso fortuito, anche ove dipendenti da malfunzionamenti e disservizi della rete internet, nel caso in cui non riesca a dare esecuzione all’ordine nei tempi previsti dal contratto.

2. La disponibilità di ogni articolo è solo a titolo indicativo, non ha carattere contrattuale e non potranno essere attribuite al venditore responsabilità in caso d’indisponibilità di uno o più prodotti.

ARTICOLO 9 – Integralità

Le presenti Condizioni Generali di Vendita sono costituite dalla totalità delle clausole che le compongono. Se una o più disposizioni delle presenti Condizioni Generali di Vendita è considerata non valida o dichiarata tale ai sensi della legge, della regolamentazione o in seguito a una decisione da parte di un tribunale avente giurisdizione, le altre disposizioni continueranno ad avere pieno vigore ed efficacia.

ARTICOLO 10 – Diritto applicabile e giurisdizione competente

Le presenti Condizioni Generali di Vendita sono sottoposte alla legge italiana. Ogni controversia che non trova soluzione amichevole sarà sottoposta alla competenza esclusiva del Tribunale del luogo di residenza o di domicilio del CLIENTE, se ubicati nel territorio dello Stato

ARTICOLO 11 – Informativa sulla Privacy

Il Cliente è tutelato dalla legislazione italiana in merito alla Informativa sulla Privacy (D.lgs. 196/2003).
